In terms of its impact on the 2018 midterms, the third scenario, which involves the Senate defeating (or at least delaying) Kavanaugh, looks even worse for Democrats. That could be the case, but for now, pressure has ramped up on Sens. With Sen. John McCain, R-Ariz., receiving cancer treatment in his home state, Republicans need all 50 Republicans, plus Pence as a tiebreaker, to confirm Kavanaugh, assuming no Democrats join them. The downside is that they'll be persona non grata in the party.

Kavanaugh: "On the question of Roe v. Wade, if confirmed to the DC Circuit, I would follow Roe v. Wade faithfully and fully". Then again, in the nightmare scenario, the GOP could pick-up all of these seats.

This issue may not get as much buzz as abortion or health care, but it's probably the one that's directly relevant to Trump.

Thomas Jipping of the Heritage Foundation tells CBN News he doesn't expect much serious evaluation of Judge Kavanaugh from Democrats. Republicans argue that it's hardly relevant to his judicial philosophy or temperament, and most of the paper would constitute Kavanaugh had little or no input on.

"His own writings make clear that he would rule against reproductive rights and freedoms, and that he would welcome challenges to the constitutionality of the Affordable Care Act".

Primus said it's unlikely the Supreme Court's decision legalizing same-sex marriage would be overturned, but speculated that Roe v. Wade is "somewhere between in danger and definitely gone".

"The hearings make a the ideal cable news story, because they offer a rich bounty for hosts and pundits to build their shows around for days on end". Democrats also focused on a law review article Kavanaugh wrote in 2009 that said a president should not face criminal investigation while in office, and instead be impeached for wrongdoing.

She said that with Kavanaugh's credentials, "it's very hard for anyone to tell me that he's not qualified for the job". Similar Democratic efforts failed to stymie Trump's first Supreme Court selection, Neil Gorsuch, who was confirmed with all Republicans and three Democrats supporting his nomination. Kennedy was a key swing vote in cases upholding abortion, affirmative action and gay rights.

Vice President Mike Pence, who was accompanying Kavanaugh on Capitol Hill, expressed confidence about the nominee's prospects.

Alan Schroeder, journalism professor at Northeastern University in Boston, said that "one of the peculiarities of the Trump presidency is that everything this White House touches gets turned into a spectacle, intentionally or not". Cory Booker (D-N.J.), another member of the Judiciary Committee, said that Kavanaugh was the only person on Trump's list of Supreme Court candidates who "has said, Mr. President, in effect, we will give you immunity".

Vanita Gupta, president and CEO of The Leadership Conference on Civil and Human Rights, an umbrella coalition of more than 200 civil rights organisations in the USA, likened Kavanaugh to Trump, a property tycoon, saying "he would protect the rights of the wealthy and powerful over the rights of all".
