Kennedy also joined the plurality in upholding provisions of the 2010 health care law in King v. Burwell, which ruled that individuals who purchase insurance from the marketplaces are entitled to tax subsidies to help them purchase their insurance regardless of whether the state or federal government runs an exchange in the consumers' state. Conservatives are celebrating, while liberals are in a panic.

KING: Sarah Weddington was a 26-year-old attorney from Texas when she argued Roe v. Wade in front of the Supreme Court and won.

Granting cert, as Shapiro noted, requires at least four votes from the justices. The nomination of David Souter, who was originally expected to vote with the conservative wing of the Court, was protested by the National Organization for Women and its leader Molly Yard who testified that Souter would "end freedom for women in this country". That did not happen and it lost by three votes. Why?

Kavanaugh's record reportedly held little indication as to his judicial leanings on abortion. The known states to have implemented such "trigger" laws are Louisiana, Mississippi, North Dakota, and South Dakota, with another dozen or so states having pre-Roe abortion bans still on the books ready to re-enact if it is federally overturned.

And now, with Judge Kavanaugh's nomination, the same dire predictions are being made.

Nixon says her mother had an illegal abortion in NY before the 1970 law decriminalized the procedure in the state. Next week he'll be threatening to challenge Kavanaugh to a duel.

Here to talk more about the issue is Chelly Hegan of Upper Hudson Planned Parenthood.

The political wing of the state's Planned Parenthood has endorsed Andrew Cuomo for a third term as governor. That standard applied to laws with a "purpose or effect [.] to place substantial obstacles in the path of a woman seeking an abortion before the fetus attains viability".

According to an analysis by the Guttmacher Institute, a reproductive-rights think tank, 19 states have adopted 63 new restrictions on abortion rights and access.

"I don't think we have any illusions about Putin or about Russia", Pence said.

A spokeswoman for the Senate Republicans, Candice Giove, answered Cuomo's charges, saying in a statement, that "Women's health issues deserve more than political stunts with stolen one-liners from 'The Apprentice.'" Giove says the Reproductive Health Act would allow non-doctors to perform abortions and also waters downs rights for pregnant women who are physically abused.
