"I'm not sure independence will ever be off the table until it is realised", Sturgeon said on Monday.

"I think people across Scotland, that's what they want: they don't want the bickering, they don't want the hyperbole they saw in yesterday's Scottish parliament debate".

The UK government has published proposals that would see the "vast majority" of these 158 powers go directly to the Scottish Parliament after Brexit.

It will be the first time since Holyrood was created.

Scottish Government ministers however fear the legislation, as it now stands, could see Holyrood's powers constrained for up to seven years after the United Kingdom quits the European Union and are demanding changes before they will give it the go ahead.

Though Tuesday's vote is not binding, it does put Theresa May into uncharted territory.

Scottish secretary David Mundell said that, although Tuesday's refusal of consent for a Westminster Bill was unprecedented, the 1998 devolution legislation envisaged such a situation. Labour, the Greens and the Liberal Democrats joined the Scottish National Party (SNP) to refuse consent by 93 votes to 30, leaving the Conservatives at Holyrood isolated.

The row centres on a set of powers which are technically devolved to the Scottish Parliament, but which are now decided at Brussels to ensure rules and regulations are the same across the EU. Ministers in both governments are discussing a fresh round of talks.

But it has also named 24 areas where it wants to retain power temporarily in the wake of Britain's exit from the European Union, including in areas such as agriculture, fisheries and food labelling.

All the governments have agreed there needs to be UK-wide frameworks for these areas, and talks involving all four administrations are ongoing.

"It is likely to be not just the SNP government that votes against legislative consent", Sturgeon told an audience in London on Monday.

Because of a general inertia among Scots over the issue, Nicola McEwen, politics professor at the Centre on Constitutional Change at Edinburgh University, suggested that the Scottish government should instead play the long game.

The UK government has the authority to simply impose the Brexit legislation on Scotland, "even if that is politically problematic [as] it would overturn 20 years of constitutional convention and precedent", she added.
